Accidents can happen in a split second — and when they do, panic is natural. But knowing how to act can protect not just your health but also your legal rights and insurance claim.


This step-by-step guide will help you stay calm, take the right actions, and understand how Indian law supports you during such situations.


🛑 Step 1: Ensure Safety First


Legal Reference: Section 134 of the Motor Vehicles Act, 1988

  • Check if anyone is injured — yourself, passengers, or others.

  • If there are injuries, immediately dial 112 for medical help.

  • If everyone is safe and it’s legally permissible, move the vehicles to the roadside to prevent further accidents.


⚠️ Providing assistance to the injured is your legal obligation and can also protect you from criminal liability.


👮 Step 2: Call the Police

Why it's important: A police report is crucial for legal and insurance purposes.

  • Dial 100 or go to the nearest police station to file an FIR.

  • Even for minor accidents, having an official record (FIR or panchnama) is essential for insurance claims.


📝 Police reports help establish fault and evidence if there's a dispute later.

Use your smartphone to capture:

  • The vehicles involved, their damage, and license plates

  • Road conditions, traffic signs, and skid marks

  • Any visible injuries or damaged property

  • A quick video walkthrough of the accident site

📷 This evidence can significantly strengthen your insurance claim.


🔁 Step 4: Exchange Information

Share and collect these details from the other parties:

  • Full name, phone number, and address

  • Driver’s license number

  • Insurance provider and policy number

  • Vehicle registration number

Also, get names and contact numbers of any witnesses present.


📞 Step 5: Notify Your Insurance Company

Under IRDAI guidelines, inform your insurer within 24 to 48 hours.

When calling, provide:

  • Police report number (or copy of FIR)

  • Photos and videos of the scene

  • A brief written summary of what happened

  • Contact details of involved parties and witnesses


⚠️ Delays in reporting may lead to claim rejection.


🛠️ Step 6: Claim Damages

Here’s what happens next:

  • The insurance company sends a surveyor to inspect the damage.

  • You may need to submit repair estimates, photos, and receipts.

  • Based on the assessment, the insurer will approve or deny the claim.


💡 If the vehicle is beyond repair, the insurer may offer the IDV (Insured Declared Value) under a total loss claim.


🔧 Step 7: Repairs & Compensation

Once approved, you can:

  • Get the vehicle repaired at an authorized or cashless garage

  • Pay the deductible (as per policy terms)

  • Get reimbursed for eligible expenses like towing or rental vehicles (if covered)


📝 Third-party insurance covers damage to others — not your own vehicle.


⚖️ Step 8: Get Legal Help If Needed

You may need legal assistance when:

  • Your claim is denied or unreasonably delayed

  • The insurer offers a payout lower than justified

  • You are falsely blamed in the FIR or face legal action

  • You want to file for injury or death compensation

  • File a case before the Motor Accident Claims Tribunal (MACT) under Section 166 of the Motor Vehicles Act, 1988

  • If the insurer acts unfairly, you can also file a case under the Consumer Protection Act, 2019
